Does the law “On deoligarchization” comply with the recommendations of the European Union?

“There is only one oligarch in Georgia, and that is Bidzina Ivanishvili,” says MEP Andrius Kubilius (Lithuania, European People’s Party).

Netgazeti addressed the MEPs with the question of how the Georgian Dream bill on deoligarchization complies with the EU recommendation.

The ruling party itself has already stated that the law will not affect Bidzina Ivanishvili.

According to Kubilius, the European Parliament resolution of June 9, 2022 clearly states that Ivanishvili is an oligarch. In particular, the document states that the European Parliament “expresses concern over the destructive role played in political and economic life by the country’s only oligarch, Bidzina Ivanishvili.”

“It is important to pass the law, but it is not enough. It is equally important to fulfill it. Considering what we have seen so far – how fiercely Georgian Dream politicians defend Ivanishvili from any critical international voice – I am not sure that the law will be properly enforced. aim [этого закона] is to protect the country from improper political influence [cо стороны человека]who is not subject to any liability and who does not take part in the elections. I hope Georgia achieves this. Otherwise, this, along with the presence of political prisoners, will be a serious obstacle to Georgia’s goal of obtaining the status of a candidate member of the EU as soon as possible,” the politician said.

Not adding Ivanishvili to the register of oligarchs is impossible, says Marketa Gregorova (Czech Republic, Greens/Free European Alliance).

“The law is a copy of the Ukrainian one, except that instead of the Presidential Administration, it will be the parliament that will decide who will be on the list of oligarchs. Many critics have warned that the law opens the door for subjective purposes. Therefore, it will become possible that parliament will abuse it to persecute the opposition. Of course, from the point of view of the European Parliament, this will be problematic. Also, some members of the Georgian Dream stated that Ivanishvili would not be included in the list. This is impossible, since he is a person who has economic and political weight in society. This is how the concept of an oligarch is explained in the law. With such legislation, it is important to create a transparent and independent, not a political body. Especially in a country where there is a problem of appropriation of the state and there is no independent court,” she said.
